Anna Maria City litigation – limiting occupancy litigation

Another Anna Maria Island party brought litigation against the City of Anna Maria for the November 19th vacation rental ordinance.   The litigation argument was, “limiting occupancy was an act of prohibition.”  The state of Florida says no local municipality can modify frequency, duration or prohibit vacation rentals in any way.  The argument was the limitation of occupancy was an act of prohibition.

Last week honorable Judge Smith ruled the City of Anna Maria MAY limit occupancy and that is NOT an act of prohibiting vacation rentals.  The litigation against the City was not successful and lost.
